Hometeam Helps, Inc. (“Hometeam”, “We”) provides support for family caregivers (“You”, “Family Caregivers”) caring for an aging or ill loved one (“Loved One”, “Patient”). Hometeam gives time and mental energy back to family caregivers by managing their administrative-related tasks like finding in-network care options, planning meals, or coordinating transportation. In turn, allowing family members to get back to doing what they do best: caring. Hometeam provides this support service (“Service”) virtually, where family members can request support by text, call or email.

Family caregivers, healthcare providers, in-home care agencies, health plans, employers and/or insurance providers and all other users (all of which may collectively be referred to as “User” or “Users”), are bound by, and should read this Hometeam Privacy Policy (“Privacy Policy”), very closely. This Privacy Policy is an effort to provide Users of our services, website (“Site”) and/or mobile application (“Mobile App”)(collectively, the “Services”), with a clear understanding of how we collect your information, how we use the information we collect, with whom we disclose such information,and the steps we take to secure the information we collect.

Your Consent to this Privacy Policy

As described in this Privacy Policy, we may use and disclose your information to provide you with products and services and to improve your experience using those products and services. By using the Site, or any other website, online service or mobile application where this Privacy Policy is posted, you agree to our collection, use, disclosure, and storage of information as described in this Privacy Policy. If you do not agree, please do not use the Site or our Services. Please take a moment to read this policy carefully to understand our practices regarding your information and how we will treat it.

1.0 Information We Collect

1.1 Information You Provide To Hometeam: When you engage with our site or services, we may collect certain personally identifiable information through onboarding forms, email, phone call, SMS text, or surveys. This information may include your name, email address, phone number, and location. We may also collect additional information about the person you are caring for, such as their past and present medical history (i.e., diagnosis, medical events, medications, etc.). If you are sharing information about a loved one on their behalf, you must be legally authorized to share such information. We may also collect financial information in order to determine eligibility for certain programs and benefits or to confirm certain services. Finally, we may collect information regarding your insurance coverage and benefits. We collect this information only with your consent and solely for the purpose of providing you with our services. Family caregivers should NOT provide Hometeam with sensitive health data nor will Hometeam ask for such.

1.2 Information Automatically Collected: We and third parties (such as Google Analytics) may use automated means to collect information about you, your computer or other device that you used to access the Site, and your use of the Site. These automated means include common technologies such as cookies, pixels, or similar technologies. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies to make the Site and Services easier to use, to make our advertising better, and to protect both you and Hometeam.These technologies help us analyze trends, administer the Site, track Users’ movements around the Site and before/after navigating to the Site, gather demographic information about our user base as a whole, and otherwise provide you with relevant content (e.g., by gathering your zip or postal code). We may receive reports on an individual as well as aggregated basis based on the use of these technologies by Hometeam, and any third-party vendors acting on Hometeam’s behalf. These third-parties have their own Terms of Use and Privacy Policies that are separate and apart from our own. We are not responsible for the privacy practices or the content, advertising, products, services or other materials made available on or through any such third-party sites.

1.3 Information From Partners: Hometeam may enter into business relationships with business partners including: in-home care agencies, health plans or health insurers, including, without limitation, employer-sponsored health plans. In addition, Hometeam may enter into business relationships with companies that contract with in-home care agencies, health plans, or health insurers to make Hometeam’s products and services available to Family Caregivers who are clients of such. Hometeam’s business partners are collectively referred to in this Privacy Policy as “Hometeam Partners.” When you use the Services, we may collect information about you, directly or indirectly, from or through applicable Hometeam Partners as well as other Users of the Services. With your consent, we may also collect Information from other third parties.

2.0 Use of Information

Our use of your personal information is limited to the purposes disclosed to you in this Privacy Policy, or by other means, as required by law. In general, we use your personal information to operate and and improve our services, including matching family caregivers with Hometeam staff, completing tasks, and communicating with you regarding our services. Hometeam, and any third party vendors acting on Hometeam’s behalf, may use your personal information for the following purposes:

  • To provide you with the Site and full functionality on the Site

  • To provide the Services.

  • To connect you with and provide you with information about services, providers of services, third parties, resources or programs to which you may have access, need access, or need to connect to for Service requests.

  • For business analytics purposes.

  • For our own marketing purposes.

  • To provide customer support to you.

  • To improve the quality of the Site.

  • To improve the quality of the Service.

  • For account and network security purposes.

  • To maintain legal and regulatory compliance.

  • To communicate with you.

  • To enforce compliance with our agreements and policies.

  • To service your account.

  • To notify you when Site updates are available.

  • To fulfill any other purpose for which you provide us personal information.

  • To create de-identified information and use such for any business purpose, such as to aggregate statistics relating to the use of the Site and Service, to create benchmark reports to analyze use of the Services, or to report to Partners.

  • In any other way we may describe when you provide the information.

  • For any other purpose with your consent.

3.0 Sharing Information

Hometeam may share your information in the following situations

3.1 Operational Service Providers: We may share your information, including Personally Identifiable Information, with third parties or affiliates to assist in our business operations or to provide the services you have requested. Examples include disclosing your information to our vendors that host our customer relationship management tool, or disclosing information to our cloud data warehouse provider to store your data. These service providers enter into contractual relationships with Hometeam requiring these service providers to only use this information as necessary to provide the services to you and Hometeam.

3.2 Third Party Providers: In connection with the Services, we may help you obtain the services of other third parties, such as car-sharing services, grocery delivery services, contractors, and parties of the like that may be engaged by Hometeam to fulfill the service requested. We may share your information with these third party service providers as we see fit and necessary upon your task request. However, please note that these third party services are not under the control of Hometeam and if you click on any links to such services or engage with such providers, you understand and agree that those linked websites and services are subject to and governed by their own separate terms and privacy policies. We do not sell personal information, and personal information will not be shared with third parties for their marketing purposes.

3.3 Care Organizations: At your direction and only with your express authorization, we may share your information with doctors, health insurance companies, care facilities and treatment centers, and other medical and related services providers associated with your care plan or the care plan of a loved one.

3.4 Family Network: Hometeam may share your information, including your Personally Identifiable Information, with your family members or other caregivers, as authorized by you, and as necessary to provide you with the Services.

3.5 Business Transfers: We may share your information, including Personally Identifiable Information, as part, of or in connection with, a merger, acquisition, assignment, as part of debt financing, the sale of company assets, or in any similar transaction, or to the extent as may be required in the unlikely event of insolvency bankruptcy, or a receivership.

3.6 Legal Compliance: We may disclose your personal information if required to do so by law or if we believe that such action is necessary to comply with a legal obligation, protect our rights or property, or ensure the safety of our users.

3.7 Sale of Personal Information: Hometeam does not “sell” personal information as defined by the California Consumer Privacy Act (CCPA) of 2018, Vermont’s protection of personal information law (9 V.S.A. § 2430), or Nevada’s 2019 privacy amendment, and have not sold personal information within the previous 12-month period from the date of this policy. If we decide to sell your personal information, we will provide you with an opportunity to opt-out as the law may require.

3.8 Other: We may disclose personal information for any other purpose disclosed by us when you provide the information. With your consent.

4.0 Communication and Marketing

4.1 Hometeam Outreach: In compliance with local rules, Hometeam may communicate with you regularly. Communications may include, without limitation, contacting you by SMS text message or at the email address(es) or at the phone number(s) that you used to register for Hometeam services.

4.2 Additional Outreach: Hometeam-introduced third-party vendors or Partners may also use your Information to communicate with you (including, without limitation, via email and/or mobile push notifications) about the Site and/or products and services (and related features and functionality).

4.3 Opting Out: In accordance with applicable law, we will offer you the opportunity to opt out of certain communications, such as, for example, communications that deal with any of our products or services you are not using but that we think might be of interest to you. Where applicable, you can opt out by emailing us at info@hometeamhelps.com. However, even if you opt out of such communications, you may continue to receive other transactional, relationship, and/or administrative communications from or through Hometeam that are important or related to your Hometeam account or the products and services you are using.

5.0 Data Retention and Disposal

5.1 Retention Period: We retain relevant Personally Identifiable Information related to your account and/or your business relationship with us pursuant to applicable federal and state rules and regulations and so long as retaining said Personally Identifiable Information is necessary including, but not limited to, the duration of time that you utilize the Services, the duration for which any amounts owed to Hometeam are due by you, and a reasonable period after termination of any business relationship. Information may persist in copies made for backup and business continuity purposes for additional time.

5.2 Deletion Request: You may request deletion of your personal information by us, however, we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete personal information, it will be deleted from the active database, but may remain in our archives (subject to applicable law) and we may also retain anonymous information about your use of our services. Once we disclose some of your personal information to third parties, we may not be able to access that personal information any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures. After we delete personal information, we may retain de-identified information and will continue to use de-identified information as permitted under this Privacy Policy.

6.0 Information Security

We are committed to ensuring the security of your personal information. We employ reasonable physical, electronic, and managerial security methods to help protect against unauthorized access to personal information, such as encryption, to protect information provided to Hometeam. But please be aware that no data transmission over the Internet or data storage facility can be guaranteed to be perfectly secure. As a result, while we strive to protect your information, we can make no representations or warranties regarding the security of any data exchanged through the Services. There are potential security risks beyond our control. With this in mind, by using the Services you acknowledge that you are transmitting data through the Services at your own risk.

As part of providing Services, our team will primarily communicate with you via SMS text messages and emails. Text messages and emails are not always secure because they travel over unencrypted networks that we do not control. As a result, we cannot ensure or guarantee the security of any information you transmit to us.

By using the Services and providing us your cell phone number and email address, you permit us to communicate with you by SMS text message and email. You may also ask us to stop by contacting info@hometeamhelps.com. You understand that you may have to pay data costs to receive SMS text messages that we send to your mobile phone.

7.0 HIPAA Governance

7.1 Information You Share: Hometeam is not a "covered entity" or a “business associate” under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191 (collectively, "HIPAA") at this time, subject to change, based on information family caregivers directly provide Hometeam. It is important to note that HIPAA does not necessarily apply to an entity or person simply because there is health information involved. Though HIPAA may not apply to any or all of your transactions or communications, we believe that your health information should have heightened privacy protections, which are also required by certain state privacy laws. We treat all health information that you provide when you onboard as valuable and private, and store it in a secure, password protected file.

7.2 Information Covered Entities Share: However, The Health Insurance Portability and Accountability Act (“HIPAA”) may apply to information disclosed to Hometeam directly from Covered Entities (as defined under HIPAA), including your healthcare provider, health plans, and certain in-home care agencies. Hometeam’s use of Protected Health Information (as defined under HIPAA) collected directly from your healthcare provider or health plan will comply with the applicable HIPAA Notice of Privacy Practices. Please contact your healthcare provider or health plan for a copy of its HIPAA Notice of Privacy Practices. For clarity, information that you provide directly to us is not governed by HIPAA.

8.0 Cookies and Tracking Technologies

8.1 Cookie Usage: Our website may use cookies and similar tracking technologies to enhance your browsing experience and collect information about how you interact with our site. These technologies may collect non-personally identifiable information, such as your IP address, browser type, and operating system. Specifically, we may use two broad categories of cookies: (1) first party cookies, served directly by us to your computer or mobile device, which we use to recognize your computer or mobile device when it revisits our Site; and (2) third party cookies, which are served by service providers or business partners on our Site, and can be used by these parties to recognize your computer or mobile device when it visits other websites. 8.3 Do Not Track: In accordance with the California Online Privacy Protection Act (CalOPPA), we want to inform you about our “Do Not Track” (“DNT”) request policy. DNT is a feature that some web browsers offer to allow Site Visitors to send signals to other websites so that no information about their browser session will be shared. We are committed to providing you with meaningful choices about the information collected on our Site for third-party purposes. However, we do not recognize or respond to browser-initiated Do Not Track signals, as the Internet industry is currently still working on Do Not Track standards, implementations, and solutions.

Our Site may contain links that enable you to visit or use other third-party websites, resources, or programs. We may share links to third-party websites, resources, or programs as a part of delivering on our services. 10.0 Children's Privacy

Our services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected personal information from a child under the age of 18, we will promptly delete it from our records.

11.0 Right to Non-Discrimination

We will not discriminate against you for exercising any of your privacy rights under law, or as set forth in this Privacy Policy.

12.0 California Regulation

In addition to the rights above, the California Consumer Privacy Act provides California consumers with certain rights, such as the right to obtain from us information about the personal information about you that we collect, use, and disclose. We will provide a list of the categories of personal information, if any, disclosed to third parties during the immediately preceding calendar year for third-party direct marketing purposes, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to the email specified above. You should put “California Privacy Rights” in the subject line and in your request. You must provide us with specific information regarding yourself so that we can accurately respond to the request.

From time to time, we may update this Privacy Policy to reflect changes to our information practices. If we make changes to this Privacy Policy, they will be reflected in an updated Privacy Policy that will be posted on the Site, and all changes will be effective upon such posting or upon any later date specified by us in writing.
